1. Before you start

By using Craftree, you confirm your acceptance of, and agree to be bound by, this Privacy Policy.

2. Agreement to Terms and Conditions

This Privacy Policy takes effect on the date on which you first use Craftree.

3. Disclaimer and Limitation of Liability

Craftree provides the Website, including all content, features, and functionality, "as is," without any warranty, express or implied, including any warranty of merchantability, fitness for a particular purpose, or non-infringement. Craftree shall not be liable for any damages arising from the use of the Website, including but not limited to direct, indirect, incidental, special, consequential, or punitive damages. This limitation applies to all claims, whether based on warranty, contract, tort, or any other legal theory, even if Craftree has been advised of the possibility of such damages. Craftree is not responsible for any user-generated content or the conduct of users on the Website.

Disclaimer

Craftree does not guarantee that the services will meet your requirements or that their operation will be uninterrupted or error-free. All express and implied warranties or conditions not stated in this Agreement (including, without limitation, loss of profits, loss or corruption of data, business interruption, or loss of contracts) are excluded and expressly disclaimed to the extent permitted by applicable law. This Agreement does not affect your statutory rights.

Warranties and Limitation of Liability

Craftree does not provide any warranty, guarantee, or other term regarding the quality, fitness for a particular purpose, or otherwise of the software. Craftree shall not be liable to you for any representations (unless fraudulent), implied warranties, conditions, or other terms, or any duty at common law, for any loss of profit or any indirect, special, consequential loss, damage, costs, expenses, or other claims (whether caused by Craftree's negligence, the negligence of its employees or agents, or otherwise) arising out of or in connection with the provision of any goods or services by Craftree. Craftree shall not be liable or deemed to be in breach of contract due to any delay in performing or failure to perform any of its obligations if the delay or failure was caused by any reason beyond its reasonable control. Notwithstanding any contrary clauses in this Agreement, in the event that Craftree is deemed liable to you for breach of this Agreement, you agree that Craftree's liability is limited to the amount actually paid by you for your services or software, which amount is calculated in reliance on this clause. You hereby release Craftree from any and all obligations, liabilities, and claims in excess of this limitation.

Responsibilities

Craftree is not responsible for what the user does with user-generated content.

General Terms and Law

This Agreement is governed by the laws of Japan. You acknowledge that no joint venture, partnership, employment, or agency relationship exists between you and Craftree as a result of your use of these services. You agree not to hold yourself out as a representative, agent, or employee of Craftree. You agree that Craftree will not be liable by reason of any representation, act, or omission to act by you.
